Account” – individual space provided to the Customer (after logging in) for the purpose of using the Service.

Contacts” – persons whose Data (in particular email addresses) is processed using the Service, or to whom Customers send electronic communication (in particular email communication).

Data concerning activity within the platform or Service “– the Data concerning your activity within the Service or platform, data concerning your session, your device and operational system, browser, localization and unique ID as registered and stored with the use of cookie or tracking scripts. This Data includes in particular: browsing history, clicks within the platform, visits to the main page and subsections of the platform, dates of creating an Account and logging into the Account, the Data related to the use of individual services in the Platform and Service, history and activities connected to our email communication with you.

Data subject “– an identified or identifiable natural person.

You”,” your” means collectively the Customers and their representatives, Contacts, website’s users, persons who have subscribed to GetResponse’s newsletter or people who contact us;

Personal Data / Data” means any personal data relating to you, that have been provided to or made available to us;

PDPA” the Malaysian Personal Data Protection Act of 2010 and its subsidiary legislation.

Processing “– operations performed on Personal Data such as e.g. collection, recording, storage, adaptation or alteration, disclosure, creating backup copies, and other operations necessary to fulfill purposes of processing, or provide the Service.

Registration Data” – the data given in registration forms available in the platform: email address, name, phone (voluntary), billing address.

Service” – all services provided by GetResponse electronically in the Software-as-a-Service model (Saas), including in particular providing the Customer with the possibility of using the Account, managing the Data entrusted to GetResponse for the purpose of Processing, and conducting marketing campaigns.

Capitalized terms that are not expressly defined in this document shall have the meanings ascribed to them in the GetResponse Terms of Service.

GetResponse undertakes all commercially reasonable endeavors to keep all disclosed Personal Data secure. Data collected through tracking and registration will not be shared or sold to third parties for any purpose without your express consent, except as provided in this Privacy Policy, or in a contract between GetResponse and you.

When you visit the website, contact us, or use our Service, we receive and may collect two types of information: (1) Website use information and cookies, and (2) Personal Data you knowingly choose to disclose, which is collected on an individual basis.

The Website may contain links to other websites belonging to or operated by third parties. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements carefully.

How do we use the data? 

The rules of how we process your Personal Data, along with the purposes and scope of the processing vary depending on whether you are our Customer, Account User, newsletter subscriber or a person with whom we establish contact or cooperation in another way. Below, we list the information about the Personal Data we process concerning the specific purposes we need it for.

  1. To provide the Service (section 6 subsection 2 lit. a and b PDPA)

While providing the Service, we carry out a set of operations that include: administrative activities related to concluding an agreement, conducting negotiations, creating a Customer Account and Customer authentication within the Account, providing materials requested by Customers or Users (also those who do not have an Account, but use our platform), activities related to the performance of the Service, including sending you communication related to use or functioning of the Service (in particular system and transactional e-mails), providing Customer support, handling complaints and other requests, charging due fees, seeking redress, and monitoring the quality of the Service.

What Data do we use and for what purposes?

To create your Account and provide the Service, we process the following Data:

  • Data provided as Account details and the password you set up.

We only store encrypted passwords and we do not have access to them.

To provide you with our Service (i.e., after you log in to your Account as our Customer), we process the following Data:

  • Data provided as Account details, including Registration Data,
  • Personal Data included in the content you send using the Service, including images, videos, files, documents or audio files,
  • Data entrusted by the Customer for the purposes of providing the Service under data processing agreement,
  • Data concerning activity within the Service.

To register for our Service, we require: (i) username, (ii) password, (iii) email address, (iv) phone number, (v) first and last name, (vi) zip code, (vii) country, (viii) billing information such as billing address and credit card number and (ix) tax identification number. We may also ask you to provide additional Personal Data such as (i) company name, (ii) title, (iii) educational background or institution, and (iv) personal details that you may opt out of by not entering data when asked.

We use your registration information for verification purposes and provide you access to our Service. We also use the email addresses used in the registration information to communicate with you. From time to time, we may contact you via email to notify you of changes to our Service, scheduled maintenance, information about GetResponse and promotional material from GetResponse. You can access your Personal Data through your Account and are obliged to update the data provided in the registration form as soon as any change in these data has occurred.

You can use the platform without creating an Account, e.g., by signing up for our newsletter, or  by filling out the contact form in any matter.

To enable you to use our platform, we process the following Data:

  • Data concerning activity within the platform or Service,
  • Data provided in the forms.
  1. For our vital interests (section 6 subsection 2 lit. e PDPA, section 6 subsection 2 lit. a and b PDPA)

We process the Data for legitimate interests of GetResponse described below, taking into consideration the relationship with our Customers, Users or other Data subjects.

What Data do we use and for what purposes?

We process the Data for legitimate interests of GetResponse described below, taking into consideration the relationship with you.

a)     For analytical purposes. To keep statistics on the use of the Service and the platform, monitor trends and features’ effectiveness, helping us to improve the Service and the platform, measure the performance of traffic sources leading to the Service, and to ensure network and information security, we process the following Data:

  • Registration Data, country, industry
  • Data concerning activity within the platform or Service.

b)      To exercise legal claims. If necessary, to establish, exercise, or defend legal claims, we process the following Data:

  • Data provided as Account details including Registration Data,,
  • Data concerning activity within the platform or Service necessary to establish a claim,
  • other Data necessary to support the claim, establish the scope of damage and other circumstances regarding the damage.

c)      To answer your queries and contact you. To respond to your queries, petitions, and complaints, to conclude and implement a contract with the entity you represent, we may process the following Data:

  • Data provided as Account details including Registration Data,
  • Data concerning activity within the platform or Service that’s the subject of your query, petition, or complaint,
  • Data included in the query, petition, or complaint and the attached documents,
  • Personal Data provided to us by you or the entity you represent in order to conclude and perform the contract.

d)      To conduct Customer satisfaction surveys. To verify Customer satisfaction with the platform or Service, we may process the following Data:

  • Registration Data,
  • answers to our survey questions.

e)      To prevent fraud and abuse. To monitor, prevent, detect, and combat fraud and abuse, including sending unsolicited content (SPAM), to protect our Customers against such abuse and to ensure network and information security, we may process the following Data:

  • Data provided as Account details,
  • Data concerning activity within the platform or Service necessary to verify potential fraud or abuse,
  • Data entrusted by the Customer for the purposes of providing the Service.

We may use, reproduce and disclose your Personal Data, including Data concerning activity within the Platform, that is anonymized, de-identified, or is otherwise not reasonably associated or linked to the Customer or your Account (or any other identifiable individual person or entity) (“Anonymized Data”) for analysis of trends, Platform’s usage and features’ effectiveness. This right to use Anonymized Data will survive termination of the deletion of the Account. We may also share aggregated information (information about our users that we combine together so that it no longer identifies or references an individual user) and other anonymized information for regulatory compliance, industry and market analysis, insights about the sector, demographic, marketing and advertising, and other business purposes. We may share this aggregated Anonymised Data with the public.

  1. To send marketing communication based on your voluntary consent section 6 Subsection 1 lit. a PDPA

What Data do we use and for what purposes?

To send our Customers, Users and Data subjects marketing and promotional communication regarding our Service or platform, we may process the following Data:

  • Registration Data,
  • Data provided as Account details,
  • Data provided when consenting to receive marketing messages.
  1. For marketing purposes, including creating your profile section 6 Subsection 1 lit. a PDPA 
  • Tailoring our Platform and Service to your preferences

We want our Service and Platform, including our marketing communication (as long as you agreed to receive it), to be tailored to your needs and preferences (profiling). We describe the nature of the profiling we carry out below.

What Data do we use and for what purposes?

To develop sales and marketing of our Service, including creating Customer or User profiles, tailored to your interests and preferences, we process the following Data:

  • Registration Data,
  • Data provided as Account details,
  • Data concerning activity within the Platform or Service.

If you have agreed to receive marketing and promotional materials, we will match the marketing and promotional content related to our products and services to your profile based on the above data. We will not send you communication about third-party products or services.

5. To comply with our legal obligations section 6 subsection 2 lit. c PDPA

As personal data controller, we must fulfill our legal obligations, e.g. to maintain tax and accounting documentation, provide answers, and submit reports required by law to the competent authorities and services. For this purpose, we may process your following data:

• Registration data,

• Data provided in the Account details,

• Data regarding activity on the Platform or Service,

• Data provided to us during correspondence, conversation or a meeting.

Who we disclose your data to?

  1. We transfer your Personal Data to the following categories of recipients:
  • Processors

We use the services of third-party providers, who process your Personal Data as data processors on our behalf. They provide us with services related to: supporting certain features of the Service: hosting, customer support, tracking security incidents and responding to them, diagnosing and solving problems with the Service or platform, analysis of our marketing campaigns efficiency, marketing, analysis of use of the Service and platform, conducting surveys, entities providing IT services, banks and entities supporting payment processing, accounting and tax advisors. Processors must meet PDPA security principle obligations.

  • Other controllers

We cooperate with service providers who don’t act on our exclusive request and who themselves determine how they process Personal Data for debt recovery, law enforcement and taxation. Also, we may share Personal Data with authorities or entities authorized to do so under applicable regulations.

We use other third parties in a scope necessary to provide the Service, such as credit card processing companies to bill you for goods and services.

We keep records of cross-border transfers to ensure appropriate transfer conditions.

If GetResponse is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on the website of any change in ownership or uses of your Personal Data, as well as any choices you may have regarding your Personal Data.

You expressly agree that we, our subsidiaries, affiliated or associated companies, or related entities controlled directly or indirectly by us and any of their respective branches and offices are permitted to collect, use, store and share the Personal Data.

You understand and agree that the Personal Data may be transferred to, used and stored in other jurisdictions, the laws of which may not offer the same level of protection as the laws of the jurisdiction which the Personal Data originates from. The Personal Data may also become subject to the legal disclosure requirements of other jurisdictions.

You understand and agree that GetResponse is permitted to disclose the Personal Data, for confidential use, to:

  • and among GetResponse group of companies;
  • comply with any law, regulation, or request by any government, court, administrative, regulatory or other authorities;
  • any agents and persons to whom GetResponse outsources the performance of its operational functions (including, without limitation, any third party service provider) and/or who provides any services, whether within or outside the country which Personal Data originates from;
  • any novatee, assignee, participant, sub-participant or transferee, or proposed novatee, assignee, participant, sub-participant or transferee of any of our rights or obligations;
  • any parties engaged by GetResponse to enable or assist GetResponse to exercise its rights and perform its obligations;

We do not guarantee the security of any information transmitted by or to us through any means of communication or correspondence (including mail, courier service, e-mail or other electronic means (including short message service (SMS)).

You accept the risk that such information may be accessed by unauthorized third parties and/or disclosed by GetResponse and by its officers, employees or agents to third parties purporting to be the intended recipient.

Regardless of the above, you agree that GetResponse will transmit such information to the address or other relevant particulars specified by you, and that such information may not be protected with encryption, password protection or any other form of security from disclosure to unauthorized third parties. You accept the risk that such transmission of information may be received, accessed or disclosed to third parties other than the intended recipient(s).

To the fullest extent permitted by law, GetResponse is not liable to you for any losses, costs, damages, expenses, claims and demands arising directly or indirectly in connection with any disclosure of information to third parties by GetResponse in the course of us carrying out the Service, including where such disclosure arose out of GetResponse’s negligence or through physical or electronic interference by a third party.

You will not hold GetResponse responsible or liable, in contract, tort (including negligence or breach of statutory duty), equity or otherwise, for any such access or disclosure or for any losses, costs, damages, expenses, claims and demands suffered or incurred by you or any third party as a result of any such access or disclosure, except for any losses which result directly and solely from GetResponse’s fraud or willful default.

You represent and warrant that you have obtained the agreement and consent of all relevant persons to any disclosure of information relating to them, which you provide GetResponse with, pursuant to this Privacy Policy. You shall indemnify and hold GetResponse harmless from and against any consequences, losses, damages, costs and/or expenses (including all legal costs on an indemnity basis) whatsoever and howsoever resulting from any failure to obtain such consents.

Which countries is your data transferred to?

With respect to Personal Data which you provide us with, you confirm that processing such data is in accordance with any applicable data protection legislation and Privacy Policy and will not cause GetResponse to breach any applicable data protection legislation. You agree that we may process and transfer these Personal Data to our affiliates and/or relevant subcontractors (who may be located in other territories) for the purposes provided herein.

Recipients to whom we transfer the Personal Data to are based mainly in Poland for contract conclusion and enforcement. If you use some functionalities of our Service, such as Chat or SMS, your Personal Data may be transferred to the USA or Singapore for contract conclusion and enforcement. Our debt collection agency is based in Singapore to enforce our vital interests of payment obligations. Other taxation, accounting and legal advisors are based in Malaysia. In order to adequately secure such transfer we use standard contractual clauses as an appropriate measure to protect Personal Data 

Do I have to provide GetResponse with my Personal Data?

Sometimes we ask you to provide us with your Personal Data. Providing:

  • Registration Data
  • Data provided as Account details, and
  • other Data (indicated as mandatory) in registration forms

is essential for us to create your Account, enter or perform the contract, meet legal obligations, send you the requested materials or contact you. If you don’t provide us with the relevant Personal Data, you will not be able to use some or all features of the platform or Service, receive newsletter, get information or receive answer. Providing us with Personal Data other than the mandatory is voluntary.

Where we provide you with the personal data of our employees, officers, servants, agents and advisors, you agree to keep it confidential and in accordance with any applicable data protection legislation.

How long do you store my Personal Data?

The data processing period depends on the purpose of processing. We will retain your Personal Data for as long as needed to provide the Service. We will retain and use your Personal Data as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. The provision of Personal Data in connection with your use of the Service is voluntary. Note, however, that the refusal to provide certain data may make it impossible for you to use all or part of the Service functionalities.

If you are our Customer, we store your Personal Data for the time during which you have an Account with our Service. When we deactivate your Account, we’ll store your Data for 30 days for the sole purpose of enabling you to reactivate the Account. During that time, we’ll only store your Personal Data without any other processing activities subject to our other obligations or rights arising from applicable laws or public authority orders. After that time, we’ll delete your Personal Data from the main database, without the possibility to recover it. In the next 7 days, your Personal Data will be subject to encryption and stored in backup copies only. The said 7-day period is required to delete the Personal Data completely due to the specifics of the backup copy operations.

We’ll store the Personal Data of our newsletter subscribers or persons who have agreed to receive marketing content from us until they resign.

After expiration of the periods described above, your Data will be erased, excluding the following data:

  • name,
  • surname,
  • email address,
  • Service usage history,
  • and information about expressed consents.

We will store this Personal Data for the period necessary to pursue rights or defend against claims (no longer than the limitation period established by law) and compliance with tax and accounting regulations.

In the case of data processing on the basis of our legitimate interest, the data will be processed for a period enabling its implementation or until an effective objection to the processing is submitted. 

If the basis for processing is the necessity to conclude or perform a contract, we process the data until its execution, but no longer than claims limitation period.

Your rights. 

We make sure that all Data Subjects can exercise their rights concerning their Data.

You may exercise your rights by filing a demand to the form available here. All you need to do is to inform us about the reason for your motion and the right you want to exercise. If you have an Account in the Service, you can exercise some of your rights directly after you log in to your Account. Please remember that if you change your settings in the Account, we may need up to 3 hours to apply the changes in our systems due to technical reasons. That’s why during this time you may still receive an email message from our system while it’s updating your settings.

If we decide it’s necessary, we may ask you some additional questions or ask you to provide us with additional documents to confirm your identity.

It may sound obvious, but for the sake of clarity, we would still like to point out that exercising your rights described below is free of charge, with the possible exception of providing additional copies of your Data.

You have the following rights:

  1. Right to express and withdraw your consent

If we ask for consent to process your Data, you can always choose to give it or not. We inform you about the right to withdraw your consent before giving consent. In our platform, we never ask for one consent for different Personal Data processing operations, and we never depend on the consent to execute the contract – including the provision of the Service – although consent is not necessary for its execution.

Additionally, you are entitled to withdraw any consent previously given at the point of creating an Account or using the platform and Services, including:

  • processing your email address to send you our marketing communication to your email address,
  • collecting your data by cookies or similar technologies. 

Withdrawal of your consent is effective upon execution, and it does not affect the lawfulness of processing based on the consent before you withdraw it. 

You can always withdraw your consent without detriment. It may, however, render you unable to use some of the features of the platform or the Services which we may legally render only with your consent (e.g., receiving the newsletter). 

You may withdraw your consent in one of the following ways:

  • by clicking “unsubscribe” in the email you received,
  • if you agreed to the use of cookies or similar technologies – in your browser settings,
  • as described in section with our contact details

We treat withdrawing your consent to receive marketing communication as objecting to profiling for marketing purposes.

  1. Right of access

You have the right to obtain confirmation if we process your Personal Data. If we do, you have the right to:

  • receive information on the rules of such processing,
  • access your Personal Data,
  • receive a copy of your Data.

If you have an Account with the Service, you can directly access your Personal Data you provided at all times, after logging into your Account.

The first copy of your Data is free of charge. For any further copies you request, we may charge you a reasonable fee based on the administrative costs resulting from preparing this information.

  1. Right to rectification

You have the right to rectify and complete the Personal Data you provide. You can do it yourself in your Account. Concerning other Personal Data, you have the right to have us rectify inaccurate Personal Data concerning you or complete your incomplete Personal Data.

  1. Right to erasure 

On the grounds described by the law, you have the right to have us erase your Personal Data. We’ll treat your demand to erase all your Personal Data as a request to delete your Account or terminate the Agreement, if applicable.

You have the right to have us erase your Personal Data if:

  • the Personal Data has been unlawfully processed or has to be erased to comply with a legal obligation;
  • your Personal Data is no longer necessary in relation to the purposes for which it was collected or otherwise processed;
  • you have withdrawn consent to the processing of your Data (and when there are no other legal grounds for processing);
  • you have objected to the processing of your Data for marketing-related purposes;
  • you have objected to the processing of your Data for statistical purposes of using the Platform or the Service and surveying customer satisfaction, and the objection has been considered legitimate.

We will keep some of your Data despite the demand to erase it if it’s necessary for performing our legal duties or establishing, pursuing, or defending a claim. It especially refers to Personal Data concerning your name, surname, email address, and the Platform or Service use history, which we keep to be able to address complaints and claims connected to the Platform or use of the Service.

  1. Right to restriction of processing

If you file such a demand, we will make some of the features of the Platform or Service connected to the processing of the Data covered by your demand unavailable to you while we review it. During that time, we will not send you any communication including marketing communication.

You have the right to have us restrict the processing of your Data when one of the following applies:

  • you contest the accuracy of your Data;
    • the processing of your Data is unlawful, and you request the restriction of its use instead of erasing it;
    • we no longer need your Personal Data to process it, but you require it to establish, exercise, or defend legal claims;
    • you object to the processing of your Data.
  1. Right to object

You have the right to object, on grounds relating to your specific situation, at any time, to the processing of your Data, providing that we are processing your Data based on our legitimate interests. In particular, you have the right to object to the processing of your Data for direct marketing purposes, including profiling. In such a case, we will no longer process your Data for these purposes and you will no longer receive any marketing information from us. Additionally, we’ll treat the withdrawal of the consent to receive marketing communication about our products or services as an objection to the processing of your Data for direct marketing purposes, including profiling.

If your objection turns out to be legitimate and we don’t have any other legal grounds for processing your Data, we will remove the Data you don’t want us to process.

  1. Right to Data portability

If you set up a Customer Account or you consented to the processing of your Data, you have the right to receive your Personal Data you provided to us and transmit it to another controller in a structured, commonly used, machine-readable format. We will send your Personal Data in .CSV format. This format is commonly used and machine-readable, and enables the transmission of your Data to another data controller.

If you are our Customer you may exercise your right after logging in to your Account.

  1. Right to lodge a complaint with a supervisory authority

You have the right to complain to a supervisory authority concerning the processing of your Data. In Malaysia it is Personal Data Protection Department.

Sensitive Data

We do not intentionally collect sensitive data.

Special note about children

This website and our Service is not intended for children, especially kids under 13. Children may use this website nor our Service.

Where does GetResponse get my Personal Data?

We received your Personal Data directly from you, from publicly available sources, or from your employer/contractor/entity you represent in connection with planning or establishing cooperation with GetResponse.

If we were the first to contact you, and the organization you are associated with is not in contact with us or has not established cooperation, we obtained your data from publicly available sources, including the Internet and social networking sites such as LinkedIn and related tools.

If you are a designated contact person or representative of an entity with which we are conducting talks or have established cooperation, we received from your employer/contractor/entity you represent Personal Data such as your name and surname, business telephone number or business e-mail address, place of work, position or information about the type of matters you deal with.

Automated processing

If you are our Customer and while using our chatbot you provide any personal data, this data may be processed in an automated manner.

Outsourcing of Contacts Personal Data Processing

GetResponse recognizes the importance of respecting the privacy of Contacts’ Personal Data. We make every effort to safeguard their security and privacy. GetResponse will never use the Contacts’ Personal Data other than for our Service nor to send any information other than expressly provided by you, nor will we share it with or sell it to anyone else for such use.

Contacts’ Personal Data processing may be outsourced by the Customer to GetResponse only where the Customer is the data controller or where the latter processes such personal data on the basis of applicable data protection legislation.

Contacts’ Personal Data processing may be outsourced as regards email address and other Contact-related information considered by the Customer necessary to ensure proper provision of the Service.

Further passing of the job of data processing may take place only within the limits, and for the purpose of proper provison of the Service.

GetResponse declares that it provides security measures protecting the databases and meets the technical and organizational requirements specified in applicable data protection legislation.

GetResponse also ensures the implementation of legal notices in accordance with the relevant regulations.

Passwords

Your GetResponse Account information, username, password and profile are password-protected so that you have secure access to entering and editing Personal Data. It is your responsibility to protect the security of your passwords. Access to the Service is protected by a unique username and password that is known to you only. GetResponse has designed internal security processes that encrypt your password to protect it from being divulged or accessed by anyone other than you. Neither GetResponse employees nor any of its contractors can obtain or access your password. Neither GetResponse employees nor any of its contractors will ask you for your password via mail, email, telephone or in any other unsolicited manner.

Website Use Information

Our servers automatically collect site use information, each time you visit the Website. The Website use information includes, but is not limited to the following: the domain names, operating system in use (e.g. Macintosh, Windows), browser (e.g. Mozilla Firefox, Internet Explorer) and version, the website which referred you to us, and other similar information. This information may be aggregated to measure the number of visits, average time spent on the Website, pages viewed, time and date of visits, and other similar information. We may use and disclose site use information, for example, to measure the use of the Website, improve the content, explain the utility of the Website and Service we provide, and to extend their functionality.
