e-mailing unconfirmed subscribers

Is it against SPAM policy to e-mail someone who has not confirmed, but has given their e-mail previously for information?

The person has not confirmed the wish
to be contacted therefore, they may file
SPAM complaint against you.

Please note that sometimes it is not the
owner of the email that subscribes only
the person who would like to bother other
people by subscribing them to multiple
newsletters.
