Social Media Competition

By entering into this agreement the Licensee accepts to use it in compliance with the Terms of Service stated below.

Whenever used in this Agreement, the following terms shall have the meaning defined hereinafter. "Implix" shall denote the Organizer - Implix Sp. z o.o., located at Balladyny 26, in Gdynia, Poland; “GetResponse” shall denote the product. “Competition” share refer to ‘The GetResponse Social Media Competition’. "Winner" shall refer to any natural person or entity that serves as the winner of the GetResponse Social Media Competition. “Social Media” shall refer to the organizations ‘Twitter’ (www.twitter.com) and ‘Facebook’ (www.facebook.com).

Requirements

1. To enter a competition you must hold a valid account on either facebook and/or twitter.
2. Competitions are not open to employees (or members of their immediate families) of Implix, Implix Sp. z o.o. or any subsidiary of Implix Sp. z o.o.
3. Purchase of GetResponse 6.0 is required.

Terms of Competition

1. The competition will open August 10th 2009 at 11:00 EST
2. The competition will have no close date. The competition will be complete when 30 valid winners have accepted the prize.
3. Only one entry per GetResponse account.
4. You may post one entry on both Facebook and Twitter. Your earliest post will be classed as entry for the competition.
5. If you want to enter the competition you may enter via the facebook ‘www.getresponse.com/facebook’ or twitter page ‘www.twitter.com/getreponse’. You must enter the mentioned text in order to be considered for the competition.

6. By entering the competition the winner agrees to participate in such promotional activity and material as follows. To provide a photo of the received prize, and to provide a written statement giving your statement regarding winning the competition. The Winner shall give Implix license to use all abovementioned materials as part of marketing materials and campaigns to be published both via the internet and on printed materials, including but not limited the right to use to dispose of the image of a person.

7. Incorrectly completed entries will not be eligible for the competition. Please read through the competition requirements for more information on what is required.

8. Implix reserves the right to amend these rules at any time. Implix may also create rules which will apply to a specific competition only. If we do this we will publish the amended competition rules and/or specific competition rules on the relevant competition page.

9. I agree to Implix Privacy Policy, government law and court, contact to customer service.

10. The competition is ruled by the law of the Republic of Poland and all disputes related to the competition shall be submitted for the resolution to the court of local jurisdiction of Implix.

Prize

1. The winners will be the first 30 entrants who post the mentioned text first on either twitter or facebook sites. All posts from both twitter and facebook will be combined, and the first 30 posts indentified by time will be selected the winners.
2. The first 30 accounts will be in the order they are presented on twitter and facebook.

3. In the event of entrants tying for 30th entry by posting at the exact same time on different social media pages, all tied entrants will be deemed a winner.

4. The winners will receive 2 prizes each. The prizes are as follows:
   4A. One additional month will be added to your GetResponse account free of charge.
   4B. GetResponse T-Shirt
5. Prize 4A will be automatically added to the winner’s GetResponse account on acceptance of the prize.
6. Prize 4B will be sent via post to an address desired by the winner.
7. If you win a competition, we will notify you by your social media account and via email within 72 hours of competition completion. The decision will be final.
8. If you do not reply within 72 hours your prize will be transferred to the closest entrant in terms of time of post.
9. When confirmation of acceptance is received from 30 winners, prize winners will be announce via GetResponse Blog – http://blog.getresponse.com
10. The prize will not be transferable to another person.
11. No part of a prize is exchangeable for cash or any other prize.
12. If an advertised prize is not available, we reserve the right to offer an alternative prize of equal or greater value.
13. Implix will endeavor to send prizes within a month of the competition end date but cannot guarantee this delivery time.
