How to Enroll in the Program To begin, complete the online application via our site. We will automatically accept you into our program. However, we reserve the right to reject your application at anytime and for whatever reason we deem necessary. Possible reasons for rejection include, but are not limited to, sites we find to contain sexually explicit, violent, discriminatory, or illegal content. If your site is rejected, you may reapply at any time once your site is in compliance with our standards. 2. Links on Your Site You will provide a link to Design Shrine PHP Factory through an approved Design Shrine Group Affiliate Link. These links will allow visitors to purchase websites or membership to Design Shrine PHP Factory. We will provide you with the graphics needed for your site. You may not represent Design Shrine PHP Factory, or use its trademarks, logos or other branding in any manner other than providing approved links or Approved Content. You may not sell Design Shrine PHP Factory Websites or Memberships through any other means other than the provided links. Any sales of Design Shrine PHP Factory via online auctions, classifieds or co-branded websites is prohibited and any violation of this rule will be considered a copyright infringement and prosecuted to the fullest extent of the law 3. Tracking You are welcome to use our user-friendly tracking service on the website under your membership - You do not need to be a member to be an affiliate. 4. Referral Payment and Product Commission An Affiliate site will receive a 25% commission on all memberships sold to visitors who are introduced to Design Shrine PHP Factory through the affiliated site. 5. Payment Schedule The last day of every month. 6. Policies and Pricing Any tampering of the tracking code in order to raise the prices of Design Shrine PHP Factory will result in a forfeiture of your commission fees. Any tampering of the tracking code to bypass Design Shrine PHP Factory payment processing will result in a forfeiture of your commission fees as well as prosecution. 7. Limited License You have a nonexclusive, limited, revocable right to use our icon and other like images only for the purpose of identifying your site as an Affiliate and to generate subscription sales. You may not modify any of our images. We reserve all rights for the icon, our trade names and trademarks. We may revoke your license at any time by giving you written notice. 8. Responsibility for Your Site You will be solely responsible for the development, operation, contents, and maintenance of your site. We take no responsibility for content or functionality of your site. 9. Relationship of Parties Nothing in this Agreement creates a partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. 10. Limitation of Liability We are not liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Program. 11. Disclaimers We cannot guarantee that our site will be uninterrupted or error-free, and we will not be liable for any consequences arising from any interruptions or errors. 12. Terms and Conditions The term of this Agreement will take effect upon our acceptance of your Affiliate application and will end when terminated by either party. Either party may terminate this Agreement at any time, for any reason. We may choose to terminate this Agreement if we determine your site content is inappropriate, you have breached any conditions of this Agreement, or if you are sending "spam" (mass, unsolicited e-mail messages) to customers. You are only eligible to earn referral payments on sales purchased during the term of the Agreement. We may withhold your final payment for a reasonable time to ensure that the correct amount is paid. Upon one-week's notice, Design Shrine PHP Factory may change, suspend or discontinue any aspect of this Agreement or the Service, including the availability of any Service feature, database, or other content. Design Shrine PHP Factory will review every affiliate payout manually. Affiliates will not earn commissions on sales to themselves.
